Macy’s v. Martha Stewart

July 13, 2012

NEW YORK, NY – Taking steps to enforce its exclusive deal with Martha Stewart Living Omnimedia, Macy’s sought injunctive relief to prevent the style maven from selling her wares in JC Penney stores across the country. New York State Supreme Court Justice Jeffrey Oing determined there was a high likelihood of success in Macy’s motion and granted a preliminary injunction to prevent “certain branded products” from being sold in JC Penney retail outlets.

Partner Theodore M. Grossman (Jones Day) led the litigation team representing Macy’s at the hearing, with Impact Trial’s John Christopher, Mia Pham, Randall E. Carter and Jeff Woodbury providing invaluable trial technology support throughout the hearing.

The case is Macy’s Inc. v. Martha Stewart Living Omnimedia, Inc., in the New York State Supreme Court.
