AUSTIN, TX – After just one hour of deliberation on the third day of trial before U.S. District Judge Alan Albright, a Texas federal jury found that Fortress Investment Group controls both VLSI Technology and Finjan Holdings. Intel’s defense emphasized Fortress’s influence over VLSI through a board largely composed of Fortress employees who have the authority, although they have not exercised it, to remove VLSI’s CEO. This finding will inform the court’s decision on whether VLSI is bound by Finjan’s 2012 license agreement with Intel, potentially shielding Intel from patent infringement claims. The jury’s verdict supports Intel’s position and marks a significant step in the ongoing litigation.
