Macy’s Wins Preliminary Injunction Against Martha Stewart Living

NEW YORK, NY – Taking steps to enforce its exclusive deal with Martha Stewart Living Omnimedia, Macy’s sought injunctive relief to prevent the style maven from selling her wares in JC Penney stores across the country. New York State Supreme Court Justice Jeffrey Oing determined there was a high likelihood of success in Macy’s motion and granted a preliminary injunction to prevent “certain branded products” to be sold in JC Penney retail outlets.

Partner Theodore M. Grossman (Jones Day) led the litigation team representing Macy’s at the hearing, with Impact Trial’s John Christopher providing invaluable trial technology support throughout the hearing.
